Privacy policy

Version 2026-10-18

Applies to Vértice POS, Retail and Services. Mandatory rights depend on jurisdiction and are not excluded by these documents.

This policy explains how Vértice Digital processes personal data when providing Vértice POS, Vértice Retail, and Vértice Services and Beauty and handling accounts, payments, security, support, and rights requests.

The service operator is QUIROGA SOLUCIONES E INGENIERIA SAS, NIT 900448567-2. Registered address: CALLE 30 24 38 OFICINA 403, BARRIO CAÑAVERAL, código postal 681001, Floridablanca, Santander, Colombia.

1. Scope and roles

  • Vértice as controller: determines the purposes related to accounts, prospects, subscriptions, its own billing, fraud prevention, security, support, compliance, and SaaS improvement.
  • Vértice as processor: processes, on the restaurant's or business's instructions, the data it manages about buyers, guests, employees, suppliers, or other third parties.
  • The customer as controller: determines the purposes of its operation and must inform data subjects, have an appropriate legal basis, and answer the requests for which it is responsible.

2. Data processed

We may process identity and contact details; account, role, and authentication data; country and language; company and location information; subscription, currency, payment, and billing data; support requests; security events; device, IP, and technical logs; cookie preferences; and usage metrics. We do not intentionally store complete card details when payment is handled by an external provider.

Customer operational data may include orders, reservations, contacts, deliveries, purchases, inventory, staff, or documents that the customer chooses to manage.

3. Purposes and legal bases

We process data to perform the contract, create and protect accounts, provide support, process charges, meet legal obligations, prevent fraud, respond to rights requests, and maintain continuity. We rely on consent when required by law, such as for analytics or marketing cookies, and on legitimate interests only after assessing that the data subject's rights do not override them.

4. Providers, transfers, and sale of data

Active infrastructure uses Vercel for web hosting and processing, Supabase for database, authentication and files, and Hostinger for authentication and support email. Supabase's primary database is hosted in Oregon, United States (us-west-2); this does not describe every location of other providers. Vértice operates from Colombia. International-transfer safeguards must correspond to the specific provider, service and flow; you may request information through our privacy channels. We do not sell entrusted business data or use it for our own advertising.

Payment, analytics, map and advertising providers participate only in enabled features that use them. Their role may differ from that of a business subprocessor. Processing on behalf of the business is also governed by the annex to the terms of service.

5. Retention and security

We retain information during the contractual relationship and afterward for as long as necessary for accounting, tax, security, claims defense, or deletion-request obligations. We apply company-level segregation, access control, audit logs, encryption in transit, secret management, backups, and monitoring. No system eliminates all risk; incidents will be assessed and reported as required by applicable law.

6. Rights and requests

Depending on the country, a data subject may request information, access, updating, correction, deletion, objection, restriction, portability, withdrawal of consent, or review of automated decisions, and may complain to the competent authority. Colombia recognizes consultation, complaint, correction, and deletion rights; the EEA and United Kingdom add GDPR rights; and several United States jurisdictions recognize access, correction, deletion, and choices regarding sale or targeted advertising.

You may submit requests using the contact emails in this policy without signing in, or through authenticated support. We will verify your identity proportionately and observe applicable deadlines. If Vértice acts as processor, it will forward the request to or assist the responsible company. No person will be discriminated against for exercising a recognized right.

See the public account and data deletion process.

7. Cookies and Google Analytics

Non-essential cookies and Google Analytics remain subject to the applicable preference. The panel lets you accept, reject, or customize categories and withdraw consent. See the Cookie policy.

Privacy signals and third-party tracking

On the web we do not apply an automatic response to the legacy Do Not Track (DNT) signal. It is distinct from Global Privacy Control (GPC): when we receive GPC in this browser, we disable optional analytics and marketing, including previously accepted choices. The signal does not prevent access, essential cookies or processing necessary to provide the service. It applies to this browser and site; we do not claim that it automatically synchronizes other devices or native Android choices. You can manage cookies and contact our privacy contact for other requests.

If you authorize enabled optional features, Google and Meta may receive identifiers and activity and, depending on the feature and their terms, recognize activity over time and across other sites or services. This tracking is distinct from data we process exclusively on behalf of a business. Native AdMob choices are managed separately within the app.

Web signals clarification: October 10, 2026.

8. Children

The business SaaS does not offer independent accounts to people under 18; legal capacity under the relevant jurisdiction is also required. Customers must not use it to collect children's data without the authorization and safeguards required in their jurisdiction.

9. International scope

This framework covers Colombia, the European Economic Area, the United Kingdom, the United States, Canada, Venezuela, and other Latin American countries. Applicable law depends on the facts, location, each party's role, and mandatory rules; a contractual reference to Colombia does not displace non-waivable territorial rights.

10. Changes and contact

Android and Google: when AdMob advertising is enabled and applicable conditions permit, Google may process IP addresses, device identifiers, interactions and diagnostics for ads, measurement and fraud prevention. In-app UMP choices are separate from website cookies. Google Play processes payments made through that channel; Vértice receives tokens and status information to validate access, not complete card details. Content you choose to upload through the camera or system picker is used for the requested feature. Do not send credentials or unnecessary sensitive data to support or Vi.

We will publish the current version and date. Material changes will be communicated, and renewed acceptance or consent will be requested when appropriate.

Identity and contact details updated: 2026-10-07.

Sources, recipients and separate purposes

Data come from the individual, the business authorizing a user or recording an operation, the selected authentication provider and payment channel; technical logs also arise during service. Google sign-in uses the authorized identity scope and does not authorize reading all email or files. Where data come from a business, that business provides its required notice and Vértice assists as processor.

Account and authentication data enable access and security; commercial contacts support requested responses and promotions only with the applicable choice; subscription information and tokens validate access and billing; orders, bookings, documents and images follow business instructions; logs and anti-fraud signals support security and claims. Internal access is limited to authorized personnel and external recipients depend on the enabled feature. Legitimate interest does not replace authorization required by local law.

Businesses access only their authorized relationships and operations; a buyer account does not let every merchant read its entire history. Catalogs and content intentionally published by a business are publicly accessible under those settings. Authority disclosures need a legal basis; corporate or provider changes must preserve required safeguards and notices. Using the service does not make credentials, tokens or private information public.

Providers by function and external content

In addition to Vercel, Supabase and Hostinger, the chosen feature may use Google identity, Google Play purchases, Google Maps/Places addresses and OpenRouteService routing. An OpenStreetMap view requests tiles from its provider, which receives technical data and the displayed area. An address or coordinate goes to the service necessary for the requested feature; this does not authorize campaign use. Tax providers such as DATAICO and payment providers participate only when their specific integration is enabled and identified at purchase or setup.

Importing a catalog URL queries the indicated source and, depending on the adapter, its reading service; supply only public authorized sources without private links or credentials. External images and videos, including YouTube and its content domains, may disclose IP, technical information and playback to their provider when requested content loads. The business must have publication rights. Advertising-tracking choices remain separate from data necessary for a requested feature. Table-access QR codes are generated locally without sending their URL to an external generator.

Retention by information type

Account, permissions and business data: during service and until return or deletion is completed, subject to identified legal exceptions. Billing, transactions and acceptance evidence: for the tax, contractual or claims periods applicable to the operation and country, with restricted access after their ordinary purpose ends. Support, incidents and logs: for justified follow-up, security or claims, followed by deletion or anonymization. Ask for the specific period or criterion for your data; no universal number of years applies across 23 countries.

Cookie preference lasts at most 365 days and is renewed when its version changes; optional identifiers follow the inventory. Unresolved public Vi questions are filtered and grouped for human review, without account or business identifiers attached to a question and without automatic training. The queue removes samples inactive for more than 90 days when new samples arrive and has an independent daily purge in bounded batches; removal completes in the next available cycle and failures or backlogs are reviewed. Request review of accidentally submitted personal information.

Manual local backups keep the annex's 30-day cycle except for justified recorded exceptions. Infrastructure backups have their own contractual lifecycle: their existence does not authorize reuse of deleted data or a promise of instant removal from every backup. Deletions must be reapplied after a restore. Deletion requests distinguish the global account, a merchant relationship, entrusted data and records requiring retention; uninstalling the app does not perform these actions.

Exercising rights and complaints

Contact admin@verticedigital.tech or acceso@verticedigital.tech describing your relationship with Vértice, the right and minimum locating information. No sign-in, payment or plan upgrade is required. We may seek proportionate identity or authority evidence; a complete identity document is not the default. Where another business controls the purpose, we will identify it and forward or help direct the request without exposing others' information.

In Colombia, access inquiries are answered within ten business days with the legally permitted reasoned extension of up to five; complaints within fifteen business days with a permitted extension of up to eight. In the EEA and UK, the usual response period is one month with justified extensions allowed by law. In the US and Canada, the applicable federal, state or provincial deadlines, verification, opt-outs and appeals apply; the international section does not replace them with a Colombian deadline.

If a request is partly or fully denied, we explain the reason and available review or appeal where applicable. You may complain to the competent authority and use an authorized agent where allowed. Exercising rights does not cause retaliation. Withdrawal affects future consent-based processing; processing on another valid identified ground may continue and legally required records are not erased.

Advertising, opt-outs and sensitive data

Free-plan ads do not by themselves authorize optional tracking. On the web, Google Analytics, Google Ads attribution, Meta Pixel and AdSense activate only with the applicable category and enabled feature. Rejection preserves access allowed by the plan. Own sponsorships or contextual ads must be assessed by their actual operations: calling an ad non-personalized does not mean it uses no storage, IP or other data. UMP and Android advertising-ID choices are separate from web cookies.

We do not sell or share entrusted business data for behavioral advertising. Optional ad-network processing of our own browsing data may have a different classification under some US laws. If an activity constitutes sale, sharing or targeted advertising and applicable law covers us, its required opt-out must be available before activation. GPC is honored in this browser; where the law requires applying an opt-out to a known profile, it must apply to that profile too. Request that handling through our privacy channels.

Operational modules do not enable medical records or health files. We do not request unnecessary sensitive information, customer biometric recognition or precise location for advertising. An ordinary photo is distinct from extracting a biometric template. A future feature requiring sensitive categories, an impact assessment, specific authorization or significant automated decisions will have its own information and controls before activation.

Age, representation and protection of children

Vértice is a business service and does not offer independent accounts to people under 18. Anyone contracting, administering or creating a buyer account must be at least 18 and have any additional legal capacity required locally; business representatives must also be authorized. An adult's permission does not enable a children's account the service does not offer. PEGI 3 describes app content and does not change these conditions or constitute parental consent.

An appointment, order or child's photo recorded by an adult is different from the child's own account. The business must establish necessity, have a lawful basis and any required guardian authorizations, respect the child's best interests and rights, limit access and retention, and respond to rights requests. Uploading an image for a booking or operation does not by itself authorize publication or campaign use. Data authorization, image rights and copyright are separate matters.

We do not routinely request a full birth date or identity copy to browse a catalog. If we become aware of a prohibited account or improper collection, we will restrict the affected processing during review and delete information that has no valid retention ground. A guardian may contact admin@verticedigital.tech or acceso@verticedigital.tech; we will proportionately verify identity and authority and coordinate with the business where it is controller. Do not send complete identity documents or the child's details in an initial message.

We do not authorize sale, behavioral advertising or model training using children's data processed on behalf of a business. A child-directed flow, or one involving known direct collection from children, that requires notices, verification or parental consent—including COPPA in the United States where applicable—will not be enabled without the required safeguards. Digital-consent ages are not equivalent to contractual adulthood.

Regional scope: 23 markets

Argentina, Bolivia, Canada, Chile, Colombia, Costa Rica, Ecuador, El Salvador, Spain, United States, Guatemala, Honduras, Italy, Mexico, Nicaragua, Panama, Paraguay, Netherlands, Peru, United Kingdom, Dominican Republic, Uruguay, Venezuela. A listed market does not enable every feature, payment method or tax integration, or certify local compliance. Mandatory local protections prevail; existing territorial restrictions remain.

Colombia

Habeas data, information, proof of authorization where applicable, access, correction, complaints, deletion and withdrawal under Law 1581 and applicable rules are preserved. SIC is the data-protection authority within its remit. Children's data receive heightened protection; operating from Colombia does not remove other territories' safeguards.

Spain, Italy and the Netherlands

Where GDPR applies, its rights, lawful bases, processing contracts and transfer safeguards apply alongside local cookie, child and contracting rules. Complaints may go to AEPD, the Italian Garante or Autoriteit Persoonsgegevens within their remit, without excluding another competent authority. An EU representative is assessed under the facts and legal exceptions; the Colombian contact is not presented as an EU representative. The annex does not replace standard contractual clauses or a required Europe–Colombia transfer assessment.

United Kingdom

Where applicable, UK GDPR, the Data Protection Act and current British communications, storage and access rules apply, including effective amendments. Transfers require the relevant UK mechanism where required; an EU mechanism is not presumed sufficient on its own. Complaints may be made to ICO. Representation duties are assessed separately from EU duties.

United States

Applicability depends on state, residence, activity, role and thresholds; business SaaS is not treated as a blanket exemption. Where legally recognized, you may access, know, correct, delete, obtain a portable copy, opt out of sale/sharing or targeted advertising, limit certain sensitive uses and appeal a denial without discrimination. Authorized agents and universal signals are supported where required. Entrusted purposes also follow the annex's service-provider terms; federal and sectoral rules are not replaced by CCPA.

Canada

Applicable federal and provincial rules, including Quebec requirements where relevant, govern meaningful consent, information, access, correction, protection and out-of-province processing. Privacy contacts identify the responsible person or role and cooperate with the competent federal or provincial authority. Language and contracting duties are assessed before offering the affected agreement; ES/EN alone does not establish Quebec language compliance. Existing operational or tax restrictions remain.

Other Latin American and Caribbean countries

Argentina, Bolivia, Chile, Costa Rica, Ecuador, El Salvador, Guatemala, Honduras, Mexico, Nicaragua, Panama, Paraguay, Peru, the Dominican Republic, Uruguay and Venezuela retain their applicable constitutional, data, consumer and contracting protections. No uniform law or identical rights or deadlines are assumed. Authorization, transfers, retention and responses follow each country's current rules and transitions; you may ask which rule and authority apply to your request. Future legislation is not presented as already effective.
